HIPAA NOTICE OF PRIVACY PRACTICES

Vital Health & Aesthetics

Effective Date: October 29, 2026

Your Information. Your Rights. Our Responsibilities.

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

This Notice of Privacy Practices explains how medical information about you may be used and disclosed, how you can access your information, and the rights you have under the Health Insurance Portability and Accountability Act (HIPAA).

Please review this notice carefully.

Your Rights

As a patient of Vital Health & Aesthetics, you have the right to:

  • Request an electronic or paper copy of your medical records.

  • Request corrections to information you believe is inaccurate or incomplete.

  • Request that we communicate with you confidentially through a preferred method or address.

  • Request restrictions on certain uses or disclosures of your medical information.

  • Request an accounting of certain disclosures of your health information.

  • Receive a paper copy of this notice upon request.

  • Designate an authorized personal representative to act on your behalf.

  • File a complaint if you believe your privacy rights have been violated, without fear of retaliation.

You may also request that information about a service you paid for entirely out of pocket not be disclosed to your health insurer for payment or healthcare operations, except when disclosure is required by law.

We will respond to requests in accordance with applicable federal and state privacy laws.

How to Exercise Your Privacy Rights

To request access to your records, corrections, confidential communications, restrictions, or an accounting of disclosures, contact our HIPAA Privacy Officer using the contact information at the end of this notice.

We may ask you to submit your request in writing and verify your identity or authority.

We generally respond to requests for copies of medical records within 30 days and to requests for amendments within 60 days, subject to legally permitted extensions and applicable state law.

We are not required to agree to every requested restriction. However, when you pay in full out of pocket for a healthcare service, we will honor your request not to disclose information about that service to your health plan for payment or healthcare operations, unless disclosure is required by law.

Your Choices

You have certain choices regarding how we use and share your health information.

You may tell us your preferences concerning:

  • Sharing information with family members, close friends, or others involved in your healthcare or payment for your care.

  • Sharing information during disaster relief situations.

  • How we communicate with you about your medical care.

If you are unable to express your preferences, we may share information when we determine that doing so is in your best interest or is necessary to prevent a serious and imminent threat to health or safety, as permitted by law.

Certain uses and disclosures, including most marketing uses, sales of protected health information, and most disclosures of psychotherapy notes, require your written authorization. You may revoke an authorization in writing, subject to applicable legal limitations.

How We Use and Disclose Your Health Information

Vital Health & Aesthetics may use and disclose protected health information for treatment, payment, and healthcare operations as permitted by HIPAA.

1. Treatment

We may use and share your health information with healthcare professionals involved in your care.

For example, we may share relevant medical information with a laboratory, consulting physician, or pharmacy when necessary to coordinate your treatment.

2. Payment

We may use and disclose information necessary to process payments for healthcare services.

For example, we may provide information to a payment processor or, when applicable, an insurance provider to facilitate payment for medical services.

3. Healthcare Operations

We may use and disclose health information to manage our medical practice, evaluate the quality of care, maintain medical records, and conduct appropriate administrative activities.

For example, we may review clinical records to assess treatment outcomes, improve patient safety, and maintain the quality of our services.

Other Permitted and Required Disclosures

In addition to treatment, payment, and healthcare operations, Vital Health & Aesthetics may use or disclose protected health information for certain purposes permitted or required by law. These disclosures are subject to applicable legal conditions and restrictions.

1. Public Health and Safety

We may disclose health information to authorized public health agencies or other appropriate authorities for purposes such as:

  • Reporting communicable diseases

  • Reporting adverse reactions to medications

  • Assisting with product recalls

  • Reporting suspected abuse or neglect when permitted or required by law

  • Preventing or reducing a serious threat to health or safety

2. Health Research

We may use or disclose health information for approved research activities when permitted by law and subject to applicable privacy protections.

3. Legal and Regulatory Requirements

We may disclose health information when required by federal or state law, including to authorized regulatory agencies investigating compliance with healthcare laws.

4. Organ Donation and Death Investigations

We may disclose relevant health information to organ procurement organizations, coroners, medical examiners, and funeral directors when permitted by law.

5. Workers' Compensation and Government Functions

We may disclose health information for workers' compensation claims, authorized health oversight activities, certain law enforcement purposes, and specific government functions when permitted or required by law.

6. Legal Proceedings

We may disclose health information in response to a valid court or administrative order, subpoena, or other lawful process, subject to applicable privacy protections.

7. Additional Protections for Substance Use Disorder Records

Certain substance use disorder treatment records received or maintained by Vital Health & Aesthetics may be protected under 42 CFR Part 2.

We will use and disclose these records only as permitted by applicable federal and state confidentiality requirements.

Records protected by 42 CFR Part 2, including testimony describing their contents, generally may not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against a patient without the required written consent or a qualifying court order issued after the required notice and opportunity to be heard.

A court order authorizing such use or disclosure must also be accompanied by a subpoena or other applicable legal mandate.

If we intend to use Part 2 records for fundraising, we will first provide a clear and conspicuous opportunity to opt out of receiving those communications.

When additional protections apply to these records, we will follow those protections rather than relying solely on HIPAA's general disclosure permissions.

Additional Protections Under State Law

Vital Health & Aesthetics complies with applicable Virginia and North Carolina health information confidentiality laws, including requirements that may provide additional protection beyond HIPAA.

Certain categories of health information may be subject to additional restrictions on disclosure, including some substance use disorder, behavioral health, and communicable disease records.

Where applicable state law provides greater privacy protections than HIPAA, we will follow the more protective requirements.

For medical records governed by Virginia law, patients may also request an audit trail of additions, deletions, or revisions to their records, subject to applicable legal exceptions.

For questions about confidentiality protections that apply to your medical records, please contact our HIPAA Privacy Officer.

Our Responsibilities

Vital Health & Aesthetics is committed to protecting the privacy and security of your protected health information.

Under HIPAA and applicable federal and state laws, we are required to:

  • Maintain the privacy and security of your protected health information.

  • Notify affected individuals when a breach of unsecured protected health information requires notification under applicable law.

  • Follow the privacy practices and responsibilities described in this notice.

  • Provide a copy of this notice upon request.

  • Respect your rights concerning access, amendment, and permitted restrictions on the use and disclosure of your health information.

We will not use or disclose your protected health information for purposes other than those described in this notice or otherwise permitted by law unless you provide written authorization.

You may revoke a written authorization at any time, except to the extent that we have already acted in reliance on that authorization or as otherwise permitted by law.

Changes to This Notice

Vital Health & Aesthetics reserves the right to revise this Notice of Privacy Practices.

Changes may apply to protected health information already maintained by the practice as well as information received in the future.

An updated notice will be made available at our office, on our website, and upon request.
